Property Rules at Cottonwood Cove

  1. Tenants shall only park on their Site, and in the area designated for their parking on that Site.
  2. Tenant shall be responsible to inform and ensure their guests of the Cottonwood Cove Property Rules and shall be responsible for their Guests’ actions while they are on the Property. Any action of a Tenant’s Guest that is in violation of these Rules and Regulations shall be imputed to the Tenant and shall be grounds for Tenant Default as provided for in the Lease Agreement.
  3. Any Tenants, individuals, or their guests found responsible for vandalizing property belonging to Cottonwood Cove Marina & RV Resort, tenants or guests of either, will be responsible for damages, reparation and will result in termination of the Lease Agreement as provided for herein.
  4. Only licensed vehicles operated by licensed drivers shall be allowed on the Property.
  5. Golf carts with gas or electric engines are allowed and require an annual “Permit Sticker” issued by Landlord. Operation of a golf cart without a “Permit Sticker” is an Event of Default and may result in Lease Termination as provided for in the Lease Agreement.
  6. Golf Cart Rules:

(a)           Drivers of golf carts must be at least 16 years old to operate.

(b)           Golf carts are not allowed on main entrance/exit road or county road (gravel).

(c)           Golf carts must have adequate lighting to operate after dark.

(d)           Golf cart trailers and all other trailers must be stored in designated areas.

(e)           Proof of liability insurance will be required to obtain “Permit Sticker.”

(f)            Cottonwood Cove Marina & RV Resort management must be notified anytime a cart is bought/sold so that all Permit numbers shall be correct.

(g)           Golf carts must be operated in accordance with the laws of the State of Nebraska.

(h)           Permitted golf carts are those manufactured for the use and intended purpose of golfing. Modified or crossover units that idle when not moving require prior approval from Cottonwood management, prior to use and acceptance of a “Permit Sticker.”

  1. Minibikes, ATV’s, go carts, and other motorized vehicles, etc., are not allowed on Property.
  2. Speed limit for all motorized vehicles on property is 10 MPH.
  3. Pets must be kept on a leash at all times when outside their Site area. When inside their Site pets must be appropriately restrained from leaving said area. Pets are not allowed in the lodge. Pets that create an unsafe or uncomfortable environment for other tenants will not be allowed. Barking dogs will not be allowed. Vicious breeds of dog are not allowed on the Property, including, but not limited to, pit bulls and rottweilers. Any and all determinations as to what constitutes a vicious breed of dog, what constitutes a barking dog, and what constitutes a pet that creates an unsafe or uncomfortable environment are to be made by the Landlord and such determination is in the absolute and sole discretion of the Landlord. Tenant is limited to two (2) pets per Site. Prior approval is required for additional pets. Tenant will receive one notice of non-compliance of the rules relating to pets on the Property. A second shall be cause for Lease Termination as provided for in the Lease Agreement. Tenant is responsible for removal of pet waste and disposal.
  4. Dumping of trash or waste shall occur in designated dumpsters. Dumpsters are not intended for yard waste or waste generated off-property.
  5. Tenants are responsible for containing and properly disposing of all waste.
  6. Fireworks are only to be used in accordance with Nebraska law. Use of fireworks not in accordance with Nebraska law or during quiet hours may result in termination of the lease.
  7. Electrical service is to be used by Tenants for their camper only.

14. Tenant shall have liability insurance that covers all Tenant’s action and activities on the Property, and any claim that may be made against Tenant or said actions. In addition, Tenant shall have current and valid insurance covering all Tenant’s Property, including, but not limited to, Tenant’s campers, boat, vehicles, golf cart, Tenant Site improvements. Tenant shall provide Landlord with proof of insurance as provided for herein, failure to provide such insurance is an Event of Default and Landlord may terminate Tenant’s lease as provided for in the Lease Agreement.

15. Tenant shall comply with all applicable statutes, laws, ordinances, rules and regulations adopted by FEMA, State, County or City, which pertains to the use of the Property.

16. Tenants shall carry a flashlight or wear high visibility clothing when walking on roads after dark.

17. Quiet time shall be 10:00 PM on weeknights and 12:00 AM on weekends and holidays.

18. Camper Rules:

  • All campers must stay in a “mobile ready” state, complete with wheels and hitch.
  • All campers must have and maintain current license plates/tags and insurance.
  • Tenant is responsible for campfires not to exceed two feet above fire ring.
  • Improvements in the campground require prior approval due to changing FEMA Regulations.
  • Clotheslines or burning or trash is not allowed.
  • Tenant is responsible for securing the proper fittings to ensure a tight connection to sewer drop pipes.
  • Tenant is responsible for winterizing camper and disconnecting water line to camper. Damage and expense to Landlord’s property caused by frozen hoses, lines or neglect, will be at the expense of Tenant.
  • Cottonwood Cove Marina & RV Resort is required to follow local ordinances relative to the lengths of stay.
  • Landlord is not responsible, nor liable, for any of Tenant’s Property or Site Improvements that is lost, stolen or damaged in any way.
  • Use of utilities is intended for the normal use of camping or boating. Misuse (i.e., washing of boats or vehicles, allowing A/C to run while not using camper) of water, power or wastewater will not be allowed.

SPECIFICALLY, TENANT ACKNLOWEDGES AND UNDERSTANDS THAT THE PROPERTY IS LOCATED ON THE BANKS OF THE MISSOURI RIVER, WHICH IS A LARGE AND UNPREDICTABLE WATERWAY. DUE TO THIS PROXMITY AND THE UNCERTAIN NATURE OF THE RIVER, THE PROPERTY IS AT RISK FOR FLOODING AT ANY TIME. LANDLORD MAKES NO REPRESENTATIONS AS TO THE SAFETY OF THE PROPERTY FROM FLOODING OR AS THE SAFETY AND SECURITY OF TENANT’S PROPERTY AND SITE IMPROVMENTS FROM BEING EXPOSED, DAMAGED OR LOST FROM ANY SUCH FLOODING. TENANT AGREES AND SHALL HOLD LANDLORD HARMLESS FROM ANY SUCH DAMAGE, CLAIMS AND/OR LOSS AS A RESULT OF ANY FLOODING ON THE PROPERTY. TENANT FURTHER UNDERSTANDS AND ACKNLOWEDGES THAT ANY SUCH FLOODING IS OUT OF THE CONTROL OF THE LANDLORD AND TENANT SHALL NOT BE ENTITELD TO ANY RENT ABATEMENT OR REFUNDS OF DEPOSITS, RENT OR MEMBERSHIP FEES PAID AS A RESULT OF THE PROPERTY BEING CLOSED OR UNUSABLE DUE TO ANY FLOODING.

Trailer Parking:

  1. All trailers, including, but not limited to, boat trailers and enclosed trailers are not allowed to be parked on Tenant’s
  2. Boat trailer parking is provided on the South end of the “overflow” parking area.
  3. Trailers for boats used at Cottonwood Cove Marina & RV Resort are the only trailers allowed to be parked on the property.
  4. Campsites must maintain space to park one vehicle.
  5. Parking vehicles on roadway cannot impede traffic or emergency vehicles.
  6. No swimming, diving or fishing is permitted in the marina.
